In this article we will present in short lines the New Immigrations Rules applicable for both UE citizens and NON -EU Citizens after BREXIT . We will post regularly new articles on our website, detailing each visa route under the new rules with effect from January 1 2021
On 1 January 2021, the transitional period after the withdrawal of Great Britain from the EU expired. Only those EU citizens who entered the country by December 31, 2020, inclusive, will have the opportunity to apply for residency status ; pre-settled status or settled status . The application deadline is 30 June 2021. European citizens who have been granted pre-settled status or settled status will only be allowed to enter the UK with an ID card, at least until 31 December 2025. They will not be the necessary visas to stay or work in the United Kingdom.
European citizens without pre-settled or settled status can only enter the UK as visitors . They cannot work or study without relevant visa.
From 1 January 2021, European citizens who do not qualify residency or temporary residency status will be able to enter and reside in the UK without a visa for a short stay of up to 6 months. EU, EEA and Swiss citizens can travel to the UK for holidays or short trips without needing a visa. You can cross the UK border using a valid passport which should be valid for the whole time you are in the UK.
The new UK Visas. The UK has introduced a points-based immigration system.
Those European citizens who do not have residency or temporary residency status but intend to reside for more than 6 months for work, study, or want to settle in the UK will be required to apply for a visa.
In order to be eligible for a visa in any of the five tiers you must pass a points-based assessment. Each tier has different conditions, entitlements, and entry requirements for people wishing to live and work in the UK and each tier will necessitate you to allocate a sufficient number of points to gain entry clearance or leave to remain in the United Kingdom. Points are allocated according to traits, such as age, qualifications, earnings, language and funds, with a different number of points needed for each of the five tiers.
The ability to fund your initial stay in the UK and your ability to speak English will play a very significant role in most cases.
The following Visa routes are open for both EU and non-EU citizens:
– Skilled worker route – A Skilled Worker visa allows you to come to or stay in the UK to do an eligible job with an approved employer.
- Under the new rules, workers can only get a UK work visa if they earn 70 points.
- Before earn any points, their job must pay a bare minimum of *£20,480 a year.
For a start, to get 50 points, they must fulfil all of the following – which are non-negotiable. They must:
- Have a job offer from a licensed sponsor (20 points )
- Speak English to an acceptable standard (10 points)
- Ensure their job offer is at skill level RQF3 (A-level equivalent) or higher (20 points)
- They must then also earn 20 extra “tradeable” points – such as by having a higher salary than £24,480year , working in a shortage job, or having a PhD.
– Health care – It enables individuals to come to the UK to work if they are working in eligible health occupations, with a job offer from the NHS, social care sector or organizations that provide services to the NHS.
– Global talent route – This route is designed to attract recognised global leaders and promising individuals in science, humanities, engineering, the arts and digital technology. Top scientists and researchers can benefit from a quicker endorsement process as part of a fast track STEM scheme.
– Student route – Students will be covered by the points-based system. They will achieve the required points if they can demonstrate that they have an offer from an approved educational institution, speak English and are able to support themselves during their studies in the UK.
– The Start-up and Innovator routes – Are designed to attract entrepreneurial talent and innovative, scalable business ideas to the UK. Start-up is for those setting up an innovative business for the first time, and Innovator is for those with industry experience and at least £50,000 funding. Applicants can be individuals or teams.
And some tips:
- From 1 January, postal and parcel items to and from the UK must now be accompanied by customs declarations. Customs declarations do not need to be completed when it comes to sending a letter, card or document.
- If you have a pet, it is important to know that the European passport will no longer be valid for them.
- You can still drive with your UK driving licence anywhere in EU.
